Terms of Purchase and Sale

11GENERAL PROVISIONS
1.1. These purchase and sale terms and conditions (hereinafter – Terms) establish the mutual rights, obligations and responsibilities of MB "Kompiuterių guru", į. k.: 305716024, address: K. Donelaičio g. 64 LT-74168 Jurbarkas, tel.: +37069339903) (hereinafter – Seller) of the SHOPRO.LT e-shop (hereinafter – Shop) and goods buyers (hereinafter – Buyer), and the procedure for ordering, payment, delivery and return of goods.
1.2. The Terms are prepared in accordance with the Civil Code of the Republic of Lithuania, the Consumer Rights Protection Law, the Personal Data Legal Protection Law and other applicable legal acts.
1.3. By placing an order in the Shop, the Buyer confirms that they have read these Terms and agree to abide by them. The Terms apply to all product orders and purchase-sale contracts concluded in the Shop.
1.4. The Seller has the right to change these Terms at any time by publishing a new version on the Shop website. Changes take effect from the moment of their publication. If the Buyer continues to use the Shop after the publication of changes, it is considered that they agree to the new version of the Terms.
1.5. The following persons may purchase goods in the Shop:
• Legally competent natural persons (who have reached the age of majority);
• Minors from 14 to 18 years old with parental or guardian consent;
• Legal entities;
• Duly authorized representatives.
2CONTRACT FORMATION AND ORDER PROCEDURE
2.1. The purchase-sale contract is considered concluded from the moment when the Buyer:
• Has formed a shopping cart;
• Has provided all necessary data (name, surname, contacts, delivery address);
• Has selected payment and delivery methods;
• Has read the Terms and confirmed agreement;
• Has clicked the "Confirm order" button.
2.2. Upon receiving an order, the Seller sends a confirmation email within 24 hours to the email address specified by the Buyer with detailed order information and payment instructions.
2.3. The Seller has the right to cancel an order if:
• Errors are found in product prices or specifications;
• Products are not in stock and their replenishment is not planned;
• The Buyer has provided misleading information.
3PRICES AND PAYMENT PROCEDURE
3.1. All product prices in the Shop are indicated in euros, including VAT. Delivery cost is not included in the product price and depends on the selected delivery method and order amount.
3.2. The Buyer can pay for the order using the following methods:
• Online banking – having a contract with any Lithuanian bank;
• Bank transfer – transferring funds to the Seller's bank account;
• Payment in installments – if a leasing or loan agreement is concluded with payment acceptance partners;
3.3. Order fulfillment begins only after receiving full payment. In case of partial payment, the order is considered unconfirmed.
4PRODUCT DELIVERY
4.1. The Seller offers the following delivery methods:
• Courier delivery – to the address specified by the Buyer in Lithuania;
• Delivery to parcel machines – "DPD" networks;
4.2. The specific product delivery time is indicated in the product description and may vary depending on the product's physical location and local warehouse stock availability.
4.3. The Buyer must provide an accurate delivery address and receive the goods personally or through an authorized representative. If goods are not received at the specified time, they are returned to the warehouse, and additional delivery costs are borne by the Buyer.
5PRODUCT WARRANTIES
5.1. All new products are covered by the manufacturer's warranty, the terms and conditions of which are specified in the product description or warranty document.
5.2. Refurbished products are provided with a minimum 3-month warranty unless otherwise specified.
5.3. Warranty does not apply to:
• Software operation issues;
• Data loss or recovery;
• Damage arising from improper use;
• Mechanical damage;
• Situations not exceeding the manufacturer's allowable number of "dead pixels" on LCD screens.
5.4. Warranty service procedure:
• Contact the Seller by email or phone;
• Provide the purchase document (invoice);
• Describe the nature of the defect in detail;
• Deliver the product for inspection and repair.
6PRODUCT RETURN AND EXCHANGE
6.1. The Buyer has the right within 14 days from receiving the goods to withdraw from the purchase-sale contract without giving a reason, if the product:
• Is undamaged and unused;
• Retains its original commercial appearance;
• Is returned in original packaging with all accessories.
6.2. The right of return does not apply to the following products:
• Individually configured computers;
• Software products with broken protections;
• Products manufactured according to individual order.
6.3. Product return procedure:
• Contact the Seller by email [email protected];
• Specify the order number and reason for return;
• Receive return instructions;
• Deliver the product to the store or send by mail.
6.4. Money for returned products is transferred within 14 working days from the product return. Return costs are borne by the Buyer, except in cases of non-quality products.
7PERSONAL DATA PROTECTION
7.1. The Seller processes the Buyer's personal data in accordance with the requirements of the EU General Data Protection Regulation (GDPR).
7.2. Data is processed for the following purposes:
• Order fulfillment;
• Customer service;
• Compliance with legal requirements;
• Direct marketing (with consent obtained).
7.3. The Buyer has the right to request correction, deletion of their data, restrict their processing or receive data in a portable format.
8LIMITATION OF LIABILITY
8.1. The Seller is not responsible for Shop operation disruptions if they occurred due to reasons beyond the Seller's control.
8.2. The Seller is not responsible for damage arising from incorrect data provided by the Buyer or non-compliance with these Terms.
8.3. Both parties' liability is limited to direct damages. Indirect damages are not compensated.
9DISPUTE RESOLUTION
9.1. All disputes are resolved through negotiations. If no agreement is reached within 30 days, disputes are resolved in the courts of the Republic of Lithuania.
9.2. In case of consumer disputes, the Buyer may contact the State Consumer Rights Protection Service (www.vvtat.lt) or use the European Online Dispute Resolution platform (ec.europa.eu/odr).
10FINAL PROVISIONS
10.1. These Terms are governed by the law of the Republic of Lithuania.
10.2. If any provision of the Terms becomes invalid, other provisions remain in force.
10.3. All contracts are archived in the Seller's database and stored for the periods established by legal acts.
